Wilford H. M. Morris brings this cause before us on his petition for transfer. The Corut of Appeals, Third District, in Morris v. Weigle, (1978) Ind.App., 375 N.E.2d 677, affirmed the trial courts judgment which was in favor of the Weigles. We now grant transfer. We vacate the opinion of the Court of Appeals and reverse the judgment of the trial court.
